By using Handshake HQ, you agree to the following Terms & Conditions. These terms and conditions may be updated at any time

Defined Terms

“Account" – Upon the provision of Required Account Information, the ability to use and administrate the Service in compliance with these Terms of Service.

“Account Admin" – An Account Admin is the registered user who has registered to use HandshakeHQ.com. If it is a paid account, this person is responsible for billing and adding additional account users. All accounts must have one designated Account Admin. An Account Admin may be a single person or legal entity.

“Account User” - An Account User may not be a “crawlers", “bots" or other automated form or technology. An Account Holder may only sign up for and maintain one free account.

“Required Account Information" – Legal full name, a valid email address, and any other information required in order to complete the Account Admin sign up process.

“Content" – All data entered into your Account, including but not limited to, templates, emails and contact information.

“Service" – The online application and technology that is made available via http://www.handshakehq.com.

Own Risk – Account Admin and Account Users of Handshake HQ agree to use the service at their own risk.
Single User of Each Logon – It is a violation of this Terms of Service to share a login. Single user accounts may only have one person using the system.
Account management – It is the account admin’s responsibility to secure access to accounts and protect the data. Handshake HQ cannot and will not be liable for loss or damage due to failing to secure account and password information.
Age Restrictions – You must be 13 or older to use Handshake HQ and you must be 18 or older to be the admin of a paid Handshake HQ account
Content Responsibility – Any account user can modify some or all information. It is the responsibility of the Account Admin to set standards and processed to ensure data is properly managed and shared among users. Account Admin’s retain rights to all data in system. Handshake HQ has the right to remove any information that is considered threatening, abusive, unlawful, offensive, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
SPAM – Each email in the system is a personal email delivered to someone. It is not used for bulk email. Templates help Account Users write better messages but each message should be customized. Manner of Use - Account Users are not permitted to use the Service for any illegal or unauthorized purpose(s). Account Users must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws, and applicable federal, state and local laws). All uses of the Service must comply with the CAN-SPAM Act.
Term Violation – Any violation of these Terms of Service will, at the discretion of Handshake HQ, be terminated.
Free Accounts – Free Accounts are limited to one per person. Even if you delete a free account, you will not be able to set up another free account with the same email.

Account Admin or other third parties agree that it shall not cause or permit the modification, disassembly, decompilation or reverse engineering of the Service or otherwise attempt to gain access to the source code of the Service. Account Holders or other third parties may not modify, adapt, translate or create derivative works based on all or any part of the Service.

Access and Availability

Account Admin is responsible for providing all hardware and Internet service necessary to gain access to and use the Service. Account Admin acknowledges that access to the Service is subject to reasonable downtimes. Account Admin further acknowledges that mechanical, telecommunications, or software failures controlled by third parties or the Account Admin may render the Service unavailable for periods of time.

Reservation of Rights

Handshake HQ owns and shall retain all proprietary rights, including all copyright, patent, trade secret, trademark and all other intellectual property rights, in and to the Service, and any corrections, bug fixes, enhancements, or other modifications to the Service, whether made/suggested by an Account Holdeer, Partner, Handshake HQ or any third party. Account Admin acknowledges that the use granted under this Agreement does not provide Account Admin with title to or ownership of the Service, but only a right of limited use under the terms and conditions of this Agreement. Customer shall keep the Applications free and clear of all claims, liens and encumbrances.

No Warranty

HANDSHAKE HQ PROVIDES NO WARRANTIES, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO ANY SOFTWARE OR SERVICES PROVIDED HEREIN, AND HANDSHAKE HQ SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NOTWITHSTANIDNG ANYTHING TO THE CONTRARY, HANDSHAKE HQ PROVIDES NO WARRANTY TO END ACCOUNT ADMIN OR ACCOUNT USERS, PARTNERS OR OTHER THIRD PARTIES PURSUANT TO THIS AGREEMENT AND ANY REPRESENTATION TO THE CONTRARY SHALL BE NULL AND VOID. HANDSHAKE HQ MAKES NO WARRANTY OR REPRESENTATION WITH RESPECT TO THE AVAILABILITY OR UPTIME OF THE SERVICE.

Termination

Handshake HQ reserves the right to suspend or delete or refuse future access, in its sole discretion, any Account or Account Holder at any time. Termination of Service will result in the forfeiture and relinquishment of any and all Content and the deactivation and ultimate deletion of your Account or your ability to be an Account Admin. Handshake HQ reserves the right to deny an Account or Account Holder status to anyone at anytime.

Service, Pricing Changes

Handshake HQ reserves the right at any time or from time to time to change, modify, delete or discontinue (either permanently or temporarily) the price (including increasing or decreasing), functionality and scope of the Service at is sole discretion. Such changes may be in whole or in part of the Service.

Cancellations, Billing and Refunds

Handshake HQ charges for its service on a monthly basis and you will be billed in advance during the last week of the month. Monthly service fees do not include taxes, levies, or duties imposed by taxing entities, and you are responsible for payment of all taxes, levies, or duties.

There are no refunds for cancellation of service for an unused month.

For service upgrades, or downgrades, you will be charged your new billing rate on the next billing month.

Limitation of Liability

Handshake HQ shall not be liable to you or any third party for update, change in price, deletion (inadvertently or on purpose), suspension or discontinuance of the Service. Account Admin hereby agree to and expressly understand that Handshake HQ shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Handshake HQ has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Service; (v) termination of your Account or Account Admin status; or (vi) any other matter relating to the Service.

Severability

The failure of Handshake HQ to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you, the Account Admin, and Handshake HQ and govern your use of the Service, superseding any prior agreements between you and Handshake HQ (including, but not limited to, any prior versions of the Terms of Service).

Assignment

Handshake HQ reserves the right to assign this Terms of Service Agreement and any rights or obligations hereunder without the prior written consent of the Account Holders as long as such Assignment does not violate Handshake HQ Privacy Policy.
